Yreka Resident Criticizes City Council Members’ Conduct

City Council,
As you both know, I have been attending quite a few council meetings as I care about our community very much. To say I am very, very disappointed with both of you is a mild understatement. Your actions have, I believe, led to much unnecessary friction, tension, and very biased opinions of fellow council members. Your interactions with Dawn Marie and Lorenzo Love are very unprofessional. That is not a healthy attitude, and many feel you should step down. It is more than time for a change. You are still on the council by a very small margin. That should give you something to mull over. You both should know that it’s obvious that your friendship affects your voting and opinions. I actually hesitated to write this, much less send it, but I am sending this in the hope that you will take my comments seriously.

    Discussion: On September 12th of 2024 Mayor Pro-Tempore Paul McCoy suffered a heart attack that left him hospitalized and unknowing of his participation for a return date to the Yreka City Council. On advice from Andrew Jared, the City Attorney, direction was given to the Yreka City Council that a vote on an extended leave of absence beyond the 60 day timeframe was required in order to comply with Government Code 36513 and allow Mayor Pro-Tempore Paul McCoy to retain his seat, if he in fact missed more than 60 days, which he did not as he only missed 41 total consecutive days. At the October 1st, 2024 Yreka City Council meeting the Yreka City Council voted on a special item added to the agenda for a leave of absence for Mayor Pro Tempore Paul McCoy. At said meeting City Attorney Andrew Jared stated, “Government code 36513 which has a 60 day time period for any councilmember who misses consecutive council meetings within a consecutive 60 day period.” It was required by the City Attorney that a vote for a leave of absence be taken in order for a possible granted leave of absence beyond the 60-day time period as stated in government code 36513. It was inferred that if a leave of absence was not granted and Mayor Pro Tempore Paul McCoy missed 60 days in between meetings that he would in fact lose his seat on the Yreka City Council based upon government code 36513. On October 1st, 2024, Drake Davis attended the regularly scheduled Yreka City Council meeting. Council member Davis missed the October 15th regularly scheduled Yreka City Council meeting and did not return to a regular Yreka City Council meeting until December 3rd, 2024, leaving a 62 day gap of no attendance between regularly scheduled Yreka City Council meetings. By definition of government code 36513 Councilmember Drake Davis appears to be in violation and has abandoned his seat on the Yreka City Council. It is apparent that Councilmember Davis violated California government code 36513 and therefore his Yreka City Council seat is vacated.

    Councilmember McCoy and Mayor Middleton are standing up for the rule of law. Colleen Baker, Drake Davis and James Clair have ignored state law and thereby violated their oath of office. This is on top of a number of Brown Act violations.
