Notice of Intent to Recall
TO THE HONORABLE Takeshi Murakami: Pursuant to Section 11020, California Elections Code, the undersigned qualified voters of Siskiyou County, City of Montague, in the State of California, hereby give notice that we are the proponents of a recall petition and that we intend to seek your recall and removal from the office of Council Member/Mayor in City of Montague, Siskiyou County. The grounds for the recall are as follows: Based on California’s Brown Act requirements, there are potential Brown Act violations to examine.
Conflict of Interest:
Tak serves as both Mayor and Assistant Fire Chief. He has voted on matters concerning his own position. As Mayor, he participates in decisions affecting the fire department where he serves as Assistant Chief. Utilizing dual roles as assistant fire chief and mayor to act in own self-interest.
Closed Session Issues:
Personnel evaluations occurring without proper notice. Reports of decisions being made without proper documentation or transparency. Actions being taken against firefighters without following required procedures.
Specific Violations May Include:
Voting on matters where he has a direct interest. Making personnel decisions outside of proper noticed meetings. Taking action on items not properly agendized. Making decisions that were supposed to be frozen by council action. Terminating Auto-Aid Agreement without Council knowing or voting.
Documentation Concerns:
Lack of proper minutes for closed sessions. Actions taken without written documentation. Failure to provide required notices for personnel actions. Posted Meeting Agenda only, no packet available online.
