NOTICE OF PUBLIC HEARING
The City of Dunsmuir Planning Commission will hold a Meeting to conduct a public hearing on Wednesday, April 8, 2026, at 6:00 p.m. to consider recommending that the City Council of the City of Dunsmuir adopt the following ordinance:
Zoning Ordinance Amendment to Dunsmuir Municipal Code Section 17.108 to Uses Permitted to Allow Commercial Cannabis Lounges within Cannabis Dispensaries Subject to First Obtaining a Conditional Use Permit from the City (ZOA 26-01)
The ordinance is a Zoning Ordinance Amendment to Dunsmuir Municipal Code Chapter 17.108, Commercial Cannabis, and specifically Sections 17.08.580 (Definitions), 17.08.2010 (Definitions), and 17.108.050 (Uses Permitted) to allow cannabis consumption lounges, as defined, in certain zoning districts subject to the operator obtaining a conditional use permit from the City. A cannabis consumption lounge is a type of land use that allows customers to consume cannabis products within restricted areas of certain approved cannabis dispensaries within the City. This public hearing is being held to consider recommending the ordinance for adoption by the City Council in accordance with Section 17.136 of the Dunsmuir Municipal Code. The Planning Commission will also review staff-recommended amendments to Chapter 5.05 of the Dunsmuir Municipal Code pertaining to business regulations of Commercial Cannabis Activities, to the extent that those amendments affect land use. The Planning Commission will not make a recommendation to City Council regarding adoption of the Chapter 5.05 amendments, but may offer comments for the Councilโs consideration.

The Planning Commission review of this ordinance is limited to recommendations to the City Council. The City Council will make the final decision on the ordinance in a separate public hearing to take place at an as-yet undetermined time and date, and which will be noticed as required under City and State law.
It is anticipated that the project will be determined to be exempt from environmental review pursuant to California Environmental Quality Act (CEQA) Guidelines Section 15061(b)(3)(Common Sense Exemption). A CEQA exemption implies that the ordinance will not result in any significant adverse environmental effects. The Planning Commission will consider the appropriateness of said environmental recommendation based on the record of evidence before them. If substantial evidence has been presented demonstrating a more appropriate environmental determination than the one being recommended, the Planning Commission may recommend to the City Council an alternative environmental determination pursuant to the requirements of CEQA.
All ordinance documents are available for public review at the City of Dunsmuir, 5915 Dunsmuir Avenue, Dunsmuir, California, and all interested persons are invited to participate in the meeting and be heard on any agenda item. In addition, a staff report will be available at City Hall and on the Cityโs website three working days prior to the Planning Commission meeting. All items presented to the Planning Commission as part of a public hearing, including but not limited to, letters, e-mail, petitions, photos, or maps, become a permanent part of the record and must be submitted to the City Clerk. It is advised that the presenter submit 12 copies of anything presented to the Commission in advance of the meeting with sufficient time for the materials to be distributed to and reviewed by the Planning Commission, and that the presenter create copies in advance for their own records.
If you challenge either the environmental determination or proposed project in court, you may be limited to raising only those issues you or someone else raised at the public hearing described in this notice, or in written correspondence delivered to the City of Dunsmuir at, or prior to, the public hearing.
